HC dismisses management plea on increase in medical seats

The Andhra Pradesh High Court on Tuesday dismissed a writ petition filed by Ap Private Medical And Dental College Managements Association against the stay orders of the Court pertaining to the increase in management quota in ‘B’ category seats of medicine.
 
The Private Medical and Dental College Managements Association approached the court to increase the management quota seats in category C from 30 per cent to 40 per cent.
 
Earlier, the High Court struck down the GO issued to increase the management quota seats and asked the state government to maintain the old system.

The Judge was passing these orders in a writ petition filed by Swathi stating that when the EAMCET notification was issued in February, at the time of examination in May 2009 and declaration of the result and award of rank, the management quota was 30 per cent of the total seats.
The petitioner contended that meritorious students applying for B category seats (merit-based with relatively higher fee) would be deprived of justice by the government’s decision which increased the C category seat (filled by Management irrespective of merit) by 10 per cent.
The petitioner further contended that the order without prior approval from the Medical Council of India was ‘arbitrary and illegal’.
She contended that the order was issued at the behest of the associations of the managements within one day of they making representation. She said that the fee structure for the management quota did not permit students like her to venture even to obtain the application form.
The state government, however, decided to honour the High Court judgment following the suggestion by the advocate general and senior officials in the medical education who reportedly said that it would lead to a long-battle leading to loss of seats in the medical colleges
